Only the King has the power to pardon and free ex-PM Najib Razak

Only the king has the power to pardon the former prime minister Datuk Seri Najib Razak, who was sentenced to 12 years in prison by the federal court. Political party leaders can only submit the royal pardon appeal, but they have no power over the court’s decision or the royal pardon.

According to Minister in the Prime Minister’s Department (Law and Institutional Reform), Datuk Seri Azalina Othman Said, Umno’s supreme council could apply to Yang di-Pertuan Agong to grant Najib Razak a full pardon, but it is up to the king to decide, as per Article 42(1) of the Federal Constitution on April 8.

 The fate of Najib is now in the hands of the “court of compassion,” she said.

“No more legal procedure, it is now in a court of compassion, at the King’s discretion. We cannot do anything. Let the King decide or study it first if he wants,” she told reporters at an event yesterday.
